1. Acceptance of Terms

By accessing and using Zenshin Japanese ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Zenshin Japanese is an online Japanese language learning platform that provides:

• Interactive Japanese language learning exercises and assignments
• Flashcard-based vocabulary and grammar practice
• Progress tracking and statistics
• Classroom features for teachers and students
• AI-powered feedback and sentence generation

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Age Requirements

You must be at least 16 years old to use this Service. If you are under 16, you may not use the Service. If we discover that a user under 16 has created an account, we will delete that account immediately.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers) to access the Service without permission
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit any malicious code, viruses, or harmful content
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

4.1 Classroom Content and Content Moderation

When using our classroom features, you agree to comply with our content moderation policies. All user-generated content, including but not limited to:

• Classroom names, descriptions, and settings
• Assignment titles, descriptions, and pre-assignment notes
• Agenda event titles and descriptions
• Tier and subroom names
• Student submissions and answers
• User display names and classroom nicknames
• Contact form messages and report descriptions

Prohibited Content: You agree not to post, submit, or transmit any content that:

• Contains hate speech, slurs, or discriminatory language targeting individuals or groups
• Promotes violence, self-harm, or harm to others
• Contains threats, harassment, or bullying
• Is illegal or promotes illegal activities
• Is sexually explicit, pornographic, or inappropriate for an educational setting
• Contains spam, scams, or misleading information
• Violates intellectual property rights or contains plagiarized content

Content Moderation: We use automated content moderation systems to detect prohibited content. If prohibited content is detected:

• Content will be blocked from being saved to our systems
• You will receive an error message indicating which specific word or phrase triggered the moderation
• You must revise your content before it can be published

Reporting Content: Users can report content that violates our policies. Reported content will be reviewed by our moderation team within 24-48 hours. Violations may result in:

• Content removal or modification
• Warnings or account restrictions
• Account suspension or termination for repeated or severe violations

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Zenshin Japanese and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

6. User Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such User Content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to grant us the license described above.

Content Moderation: All User Content is subject to our content moderation policies as described in Section 4.1. We reserve the right to review, moderate, remove, or modify any User Content that violates these Terms or our content moderation policies, without prior notice.

7. Payment and Subscriptions

If you purchase a subscription or make a payment through the Service:

• All payments are processed securely through Stripe
• Billing Period: Subscriptions are billed on a monthly basis
• Auto-Renewal: Subscriptions automatically renew at the end of each monthly billing period unless cancelled. Subscription fees are billed in advance on a recurring monthly basis
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will continue to have access until the end of the period you have already paid for
• Refunds are handled in accordance with our Refund Policy
• We reserve the right to change our pricing with 30 days' notice

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by requesting account deletion through your Privacy Settings or by contacting us.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

9.1 AI-Generated Content

Some content, including sentences, exercises, feedback, and educational materials, is generated using artificial intelligence (AI) technology. While we strive for accuracy and quality:

• AI-generated content may contain errors, inaccuracies, or inconsistencies
• AI-generated content is provided for educational purposes and should not be relied upon as the sole source of information
• We recommend verifying important information independently and consulting with qualified Japanese language instructors when in doubt
• We are not liable for errors, inaccuracies, or misunderstandings resulting from AI-generated educational content

We continuously work to improve the accuracy of AI-generated content, but we cannot guarantee perfection. Users should exercise their own judgment and seek additional resources when learning Japanese.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENSHIN JAPANESE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Zenshin Japanese, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of The Netherlands.

14. Complaints and Dispute Resolution

If you have a complaint or dispute regarding the Service, we encourage you to contact us first through our contact page. We will make every effort to resolve your complaint promptly and fairly.

We aim to respond to all complaints within 5 business days and will work with you to find a satisfactory resolution.

If we cannot resolve a dispute through direct communication, disputes will be resolved in accordance with Section 13 (Governing Law) of these Terms.
